By booking a dumpster rental, submitting payment, or using services provided by Trash Panda Rentals, the customer agrees to the following Terms & Conditions. 1. Service Agreement All dumpster rentals are subject to availability, scheduling confirmation, and approval by Trash Panda Rentals. Submission of a booking request does not guarantee service until confirmed. Trash Panda Rentals reserves the right to refuse, reschedule, suspend, or cancel service at its discretion due to weather conditions, unsafe placement locations, restricted access, equipment availability, operational limitations, or other unforeseen circumstances. 2. Rental Period The standard rental period begins upon delivery of the dumpster and ends upon pickup or expiration of the agreed rental term. Additional daily rental charges may apply for dumpsters kept beyond the agreed rental period unless otherwise approved in writing. Customers are responsible for ensuring the dumpster remains accessible for pickup during the scheduled removal date and time. 3. Payment Terms Payment may be required in full or partially in advance to secure the reservation. Accepted payment methods may include credit/debit cards, ACH bank transfer, cash, or invoiced billing for approved accounts. By providing payment information, the customer authorizes Trash Panda Rentals to charge all applicable fees related to the rental, including: Rental charges Delivery and pickup fees Overage or overweight charges Extended rental fees Contamination or prohibited material fees Trip charges due to inaccessible dumpsters Damage repair costs Returned payment or failed ACH fees Invoices not paid by the due date may incur late fees and may result in suspension of future service. 4. Weight Limits & Overage Charges Each dumpster rental includes a specified weight allowance. Any weight exceeding the included limit will be billed at the applicable overage rate. Customers are responsible for ensuring dumpsters are not overloaded above the fill line or weight capacity established by transportation and landfill regulations. Overfilled dumpsters may not be hauled until corrected, and additional trip fees may apply. 5. Prohibited Materials The following items are strictly prohibited unless explicitly approved in writing: Hazardous waste Chemicals or solvents Paints, oils, fuels, or flammable materials Batteries Tires Asbestos-containing materials Medical or biohazard waste Explosives or pressurized containers Refrigerants or appliances containing Freon Any material prohibited by local, state, or federal law The customer assumes full responsibility for any fines, cleanup costs, disposal fees, environmental claims, or damages resulting from prohibited materials placed in the dumpster. 6. Property Access & Placement The customer is responsible for providing clear, safe, and adequate access to the delivery location. The customer acknowledges that dumpster placement may cause surface damage to driveways, pavement, concrete, asphalt, landscaping, grass, underground utilities, or other property surfaces due to the weight of equipment. Trash Panda Rentals shall not be liable for normal surface wear or damage resulting from delivery, placement, or removal where conditions are outside of its control. Customers are responsible for obtaining any required permits, HOA approvals, or municipal authorizations related to dumpster placement. 7. Equipment Responsibility The customer assumes responsibility for the dumpster while it remains on-site and agrees not to: Move or relocate the dumpster Tamper with equipment Burn materials inside the dumpster Use the dumpster for unlawful purposes The customer is responsible for theft, fire damage, vandalism, or excessive damage occurring during the rental period beyond ordinary wear and tear. 8. Cancellation Policy Cancellations made prior to dispatch may qualify for a refund, less any applicable processing or administrative fees. Same-day cancellations, failed delivery attempts, or inaccessible job sites may result in trip charges or cancellation fees. Deposits and processing fees may be non-refundable. 9. Limitation of Liability To the maximum extent permitted by law, Trash Panda Rentals shall not be liable for: Delays caused by traffic, weather, mechanical failure, landfill delays, or circumstances beyond reasonable control Indirect, incidental, special, or consequential damages Loss of business, revenue, productivity, or project delays Property damage resulting from unsuitable placement surfaces or site conditions disclosed or undisclosed by the customer The customer agrees to indemnify and hold harmless Trash Panda Rentals, its employees, contractors, and affiliates from any claims, liabilities, damages, penalties, or expenses arising from misuse of equipment, prohibited waste, unsafe site conditions, or violations of applicable laws. 10. Communication Consent By submitting a booking request, the customer consents to receive service-related communications from Trash Panda Rentals, including: Booking confirmations Scheduling updates Invoices and receipts Service reminders Customer support communications Communications may be delivered via phone call, email, or SMS. 11. Governing Law These Terms & Conditions shall be governed and interpreted in accordance with the laws of the applicable state in which services are provided. 12. Acceptance of Terms By booking services through this website or accepting delivery of equipment, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
